{"id":8139,"date":"2021-01-13T08:39:56","date_gmt":"2021-01-13T08:39:56","guid":{"rendered":"https:\/\/tcaa.taxconsult.be\/?p=8139"},"modified":"2023-06-15T14:03:54","modified_gmt":"2023-06-15T14:03:54","slug":"nouvelle-obligation-liee-au-registre-ubo","status":"publish","type":"post","link":"https:\/\/www.taxconsult.be\/fr\/nouvelle-obligation-liee-au-registre-ubo\/","title":{"rendered":"Nouvelle obligation li\u00e9e au &#8220;Registre UBO&#8221;"},"content":{"rendered":"<p>Depuis la loi du 18 septembre 2017 relative \u00e0 la pr\u00e9vention du blanchiment de capitaux et du financement du terrorisme, chaque soci\u00e9t\u00e9, a(i)sbl, fondation et trust doit identifier et enregistrer ses b\u00e9n\u00e9ficiaires effectifs via la plateforme connue sous le nom de \u00ab Registre UBO \u00bb, et ce depuis le 30 septembre 2019 (tol\u00e9rance administrative jusqu\u2019au 31 d\u00e9cembre 2019).<\/p>\n<p>Suite \u00e0 la publication r\u00e9cente d\u2019un arr\u00eat\u00e9 royal, une nouvelle obligation de documentation vient s\u2019ajouter \u00e0 celle pr\u00e9existante. En effet, l\u2019arr\u00eat\u00e9 royal en question pr\u00e9voit que tous les redevables d\u2019informations ont d\u00e9sormais l\u2019obligation de fournir via la plateforme tout document prouvant que les informations enregistr\u00e9es sont \u00ab ad\u00e9quates, exactes et actuelles \u00bb.<\/p>\n<p>Cette formalit\u00e9 de documentation devra \u00eatre remplie au plus tard pour le 30 avril 2021. Une amende administrative de 250 \u00e0 50.000 EUR pourra \u00eatre inflig\u00e9e aux administrateurs des soci\u00e9t\u00e9s, a(i)sbls, fondations ou trusts concern\u00e9s en cas de non-respect de leur obligation de communication mais \u00e9galement en cas de mauvaise qualit\u00e9 des donn\u00e9es communiqu\u00e9es.<\/p>\n<p>A toutes fins utiles, nous rappelons \u00e9galement que tout changement de b\u00e9n\u00e9ficiaire effectif doit \u00eatre report\u00e9 dans le \u00ab Registre UBO \u00bb et ce, dans le mois qui suit ce changement.<\/p>\n<p>Tax Consult suit quotidiennement l\u2019actualit\u00e9 des nouvelles mesures prises et appliqu\u00e9es par les autorit\u00e9s et est r\u00e9guli\u00e8rement en contact avec l\u2019Administration (fiscale).
